TERMS & CONDITIONS FOR PURCHASE OF DIGITAL PRODUCTS

Amethyst Holistic Training provides the sale of editable course manuals (the “Course Manuals”) and home study course files (the “Home Study Courses”) referred to collectively as the “Digital Products” which may be purchased through the site. We also provide the sale of Holistic Products in our Shop . See relevant T&C's here.

These Terms and Conditions cover the terms by which you may use the Digital Products after purchase and purchase of our home study training courses.

1. TERMS AND CONDITIONS OF SALE

License of Course Manuals

On purchase of the Course Manuals, Amethyst Holistic Training grants you a non-exclusive, non-transferable licence to use the Course Manuals to:

1. Use as an in-house teaching aid

2. Share as a PDF with students

3. Share as a printed manual for students to take away after their course

4. Edit the information within the manuals for use within your own training school including adding your own logo, school name and treatment procedures.

5. Share the information within the manuals with:

   1. Your tutors as teaching materials

   2. Your students as teaching materials

   3. Accrediting bodies for the purpose of accreditation.

The Course Manuals shall not be shared with other training providers or anyone else outside of your training school.

Home Study Courses

On purchase of  the Home Study Courses, intellectual property rights of all course materials (including design, text, images, audio and other related content) are owned or licensed by Amethyst Holistic Training and are subject to copyright ©Amethyst Holistic Training, all rights reserved.   Home Study Courses shall not be used for any purpose except as study materials.

The Digital Products are subject to copyright ©Amethyst Holistic Training and must not be resold or shared to third party companies as this will breach copyright and license use of the Digital Products.

2. PURCHASE OF DIGITAL PRODUCTS

By placing an order for digital products through our site, you warrant that you are legally capable of entering into binding contracts, that you are at least 18 years old and that you are purchasing our digital products for use within your business.

You are responsible for ensuring that you do not lose, destroy or damage any digital product you purchase through this site. If a downloaded file is corrupt or has errors, please inform us or email within 7 days to rachel@amethystholistictraining.co.uk

​

You have 30 days in which to download your files before the links expire. It is your responsibility to ensure you download, save and create a backup of your digital files. Amethyst Holistic Training is not responsible for expired links, lost files or files lost due to stolen or damaged equipment. Please ensure you have backup files of your purchase.

​

In the event of a request for resending links or uploading lost files, this is chargeable at £25 per order plus a £1 charge for each file to be resent. Details on how to pay will be sent on request. We can only resend files up to 12 months from the date of purchase.

​

You are responsible for ensuring that any hardware you use to download and/or access the digital products function correctly with this site. You acknowledge and agree that the provision of all these requirements is your responsibility and is at your own cost. We are not obliged to ensure that our products are compatible with every manufacturer of mobile handsets, laptops or personal computers.

​

3. PLACING AN ORDER

After placing an order for any Digital Products via our site, you will receive an email acknowledging receipt of your purchase. 

In the case of editable manuals, these will be attached to the email confirming receipt of your purchase.

In the case of bulk orders of specific editable manuals, these will be sent via a separate email once payment has been received and the manuals requested have been confirmed.

In the case of home study courses, the first lesson will be attached to the email confirming receipt of purchase. Further lessons will be sent once the first one has been marked and approved.

The contract for the purchase of any digital products will only be formed when you have agreed to our Terms of Sale, we have received payment in full for the Digital Product/s you are purchasing and we make the Digital Products available for download. We reserve the right, in our sole discretion, to reject any order we receive.

4. AVAILABILITY

All Digital Products featured on our site are subject to availability. We reserve the right to change or remove a Digital Product or other content on the site at any time without notice or liability to you.

Where we are unable to provide you with a Digital Product you have purchased, you agree that we can offer you either alternative goods to a similar value (upon your agreement that the alternative goods are suitable) or a complete refund. We will not be liable for our inability to fulfil a particular order from you.

​5. PRICE AND PAYMENT

The price of any Digital Product will be as quoted on this site at the current time but are liable to change at any time. Changes will not affect orders for which payment has already been taken.

​

Please not that some network/service providers may charge an additional amount for downloading Digital Products to a mobile handset. We recommend that you contact you network/service provider to understand the nature and extent of any additional charges before downloading to a mobile device. Note that overseas roaming charges may also apply. We will not be held liable for any such charges.

​

By providing the details of a credit/debit card or payment account to be debited, you confirm that you are authorised to purchase the Digital Products and that you have the permission of or are the holder of the credit/debit card, PayPal or other account being used to pay for the transaction. All card payments and cardholder details may be subject to validation checks carried out by us or by the card issuer. If validation checks are required we will not be held liable for any delays or non-delivery nor are we obliged to. In respect of validation checks and authorisation carried out by the card issuer, if the issuer refuses to authorise payment we will not accept your order and we will not be liable for any delay or non-delivery or any bank charges applied to you. We are not obliged to inform you of the reason for refusal.

6. ACCREDITATION 

Accreditation of Course Manuals:

The procedure and requirements of accreditation companies may vary. All of our manuals have been accredited in the past or are currently accredited by one or more of the following companies: Beauty Guild, ABT, IPHM, IGCT. Whilst we endeavour to ensure that all manuals meet the requirements of the main accreditation providers, we cannot guarantee that some changes may be required.

Requirements of accrediting bodies vary not only between companies but may also vary from time to time within the same company. Legislation and/or company preferences may require an update or edit to the manuals.

​

You are purchasing the editable manuals on the recognition that they are fully editable and that small changes may be required before they pass the requirements of your chosen accrediting body.

​

Amethyst Holistic Training is not responsible for any requests or requirements set by your chosen accrediting body. We endeavour to ensure that manuals contain everything required and regularly update and edit manuals to ensure they are compliant.

​

No refunds, full or partial, will be issued for any changes required by accreditation companies. We are happy to try and help where issues may be based on new standards or legislation. 

​

Images used are stock images from the main stock image sites or royalty free sites meaning we have a license for use.

​

Accreditation of Home Study Courses:

Accreditation of Home Study Courses is through IGCT (International Guild of Complementary Therapists).

​

7. REFUNDS

If the Digital Products are faulty, no refunds will be granted where a repair or replacement to the Digital Products can be made, in accordance with the Consumer Rights Act 2015.

​

If Digital Products are found to be defective, we shall have the right to attend to the cause of the problem and restore the Digital Products to functioning order or offer you a repeat download. You shall not have the automatic right of refund in this case. You must notify us with 30 days of download of the Digital Product that it is defective to rachel@amethystholistictraining.co.uk

​

If we are unable to fix the problem and a repeat download does not resolve the issue, we will provide you with a full refund within 30 days of ascertaining that the issue cannot be resolved.

​

8. EVENTS OUTSIDE OF OUR CONTROL

We will not be liable for any failure or delay to perform any of our obligations under a contract for a Digital Product that is caused by events outside our reasonable control.

​

9. COMPLAINTS

10. CONFIDENTIALITY

Personal information or business information that you supply to Amethyst Holistic Training through the site, other than information that is in the public domain, will be treated confidentially and in line with our Privacy Policy. Confidential information will not be disclosed to any third party, including for the purposes of marketing, without your prior permission. We will only disclose your information if it is necessary for the performance of our services or where so required by the law.

11. VARIATION

We may change these Terms and Conditions from time to time. Please ensure that you check for any changes regularly, as you are bound by them if you use this site.

12. OUR RESPONSIBILITY TO YOU

We do not guarantee the accuracy of material on our site, and you are responsible for the way you use its content.

You shall be exclusively responsible for your use of the Digital Products. Amethyst Holistic Training’s liability in respect of any claim arising from your use of the Digital Products is hereby excluded.

We shall not be liable to you for any indirect, special or consequential loss or damage, including but not limited to:

1. Loss of profit

2. Loss of goodwill

3. Loss of savings or

4. Loss of contract.

Amethyst Holistic Training exclude, but only as far as legally possible, all terms and warranties or promises implied by law or by statutes.

Amethyst Holistic Training does not warrant that your use of the site will be uninterrupted. Amethyst Holistic Training is not responsible for any loss or damage you may suffer resulting from any interruptions, errors or the transfer of data and you acknowledge that the site may be subject to limitations, delays and other issues.

Any duty of care owed to you by us is owed to you alone and no duty of care is owed to any third party and we do not assume any responsibility to any third party in respect of the performance of our duties to you.

​

This agreement shall be governed in accordance with the laws of England and Wales.
